"INDIE MUSIC CAFE" TV SHOW

ARTIST PERFORMANCE RELEASE AGREEMENT

I, (artist), am over 18 years of age and I consent and agree that, for publicity consideration for my myself and my music, agree to appear on the program “Indie Music Cafe" (the “program”).   I hereby irrevocably grant Metro Media Group, Inc. and Indie Music Channel, as well as television and radio stations that air the program, permission to use my physical and audible likeness and appearance, as well as the recording of the music, I will be performing on the program, in whole or in part, without any creative control or financial compensation owed to me.

I also understand that my appearance and likeness will not be intentionally defamed in any way on the program.  I also understand that Metro Media Group, Indie Music Channel and the television and/or radio stations that air the program will in no way make my performance singularly available for purchase.  I understand that Metro Media Group,  Indie Music Channel and the television and/or radio stations rightfully have the authority to market the show to advertisers and sponsors of the program for broadcast purposes.  I also agree that I and, to the extent that I may have control over them, the members of my band, staff or entourage, will act in a professional manner at all times while on stage performing and throughout the program will refrain from using any profane or inappropriate language or gestures of any kind while on stage, and will not perform on stage while intoxicated or under the influence of any non-prescribed drug or excessive use of a prescribed drug.  I understand and agree that Metro Media Group, Inc. and Indie Music Channel reserve the right to refuse or revoke my ability to perform during the program and may refuse to distribute my performance for any reason at any time.  I also agree that Metro Media Group, Inc. and Indie Music Channel are not responsible for any reimbursements to me or anyone associated with me, for any travel costs, lodging, etc., associated with my participation in this program.  I also agree to hold harmless Metro Media Group, Inc. and Indie Music Channel and all of their principals, agents and employees and parties involved in the making of the program, from damages that may be incurred or for any injury that may occur to me or my band related to the program.

Further, I understand that there is no guarantee that the episode of the program that I/we are performing on will air on television and/or radio, and I also understand that electronic and mechanical failures do happen, and therefore I agree that Metro Media Group, Inc. and Indie Music Channel are not responsible for any possible failure of the recording equipment used to record the performance of myself or my band, and that should any such recording failure occur, I will not expect, or receive, any additional opportunity to conduct my performance again nor expect or receive any reimbursements of time or expenses.   I understand that any of my/our songs that would be featured on the program must be original songs that are of my own and/or my bands creation. I also agree that this is a promotional opportunity for myself and my music and I waive any collection, or expectation of, royalties on behalf of BMI, ASCAP, etc.  associated with my/our appearance on the program.

I certify that I have the authority to enter into this agreement on behalf of myself, my band members, my musicians, my record label, my agent, my manager and/or my publisher as a result of playing or promoting myself or my music in the production of the program and pledge to fully comply with all terms of this Release Agreement.   I understand that if I am making this submission on behalf of a minor child, I am representing and asserting that I have the legal fiduciary capacity to so agree with these terms on my own behalf and on behalf of said child.

I, being over 18 years of age, have carefully read and understand the terms and meaning of this Artist Performance Release Agreement and declare my agreement with the above terms by typing my Electronic Signature in the box above and clicking on the "Submit" button.
